Terms of Service

These terms are the agreement between you and Digital Native Co., a company registered in Delaware, USA ("we", "us"), for using Skyad. By playing, signing in, subscribing or booking a banner, you agree to them.

1. Who can play

You must be at least 13 years old. If you're under 18, or under the age of majority where you live, a parent or guardian must agree to these terms for you, and must make any purchase.

2. Your account

• You can play without an account; some features need you to sign in.
• Keep your sign-in secure. You're responsible for what happens on your account.
• Your callsign must not be offensive, impersonate someone else, or contain links or advertising. We may change or remove a callsign that breaks these rules.

3. Fair play

You agree not to:

• use cheats, bots, automation, modified clients or anything that gives an unfair advantage;
• exploit bugs on purpose (please report them to us instead);
• attack, overload or disrupt our servers, or try to access accounts or data that aren't yours;
• get around the ad before a free life, for example by faking an ad view;
• harass other players or use Skyad for anything illegal.

Our battle server decides every hit, kill and score, and its decision is final. We may remove scores, suspend or ban accounts that break these rules. A ban for cheating doesn't entitle you to a refund.

4. AI pilots

AI pilots fill empty seats in the battle, and top-10 planes fly as AI "aces" while their pilot is offline. AI pilots are always labelled "AI". They can appear on the leaderboard, but they are never presented as real people.

5. Free play and ads

Skyad is free. Each free life starts after you watch one short ad to the end. If no ad is available, for example because of an ad blocker, a free life may not be available at that moment.

6. The ad-free subscription

• The subscription costs US$2.99 a month (plus any tax that applies) and gives unlimited lives with no ads.
• It renews automatically every month and is charged to your payment method through Stripe until you cancel.
• You can cancel at any time with the Manage button next to your account. It stays active until the end of the month you've already paid for, then stops. We don't give refunds for part of a month, except where the law requires it.
• If we change the price, we'll tell you in advance, and the new price applies only from your next renewal after the notice. You can cancel before then.
• The subscription doesn't give any advantage in battle. Subscribers may skip the queue when the battle is full.

7. Sponsor banners (advertisers)

• You can also book one of 5 spots in the ad break shown before free players' lives for one weekly season. Each spot is on screen for one second in every break that season. The break plays when no other ad is shown, so we don't guarantee how many players see it.
• For plane banners, you book a rank (1–10), a slot on the plane, and one weekly season. Seasons run from Monday 00:00 to the next Monday 00:00, Korea time. Your banner flies on whichever plane holds that rank during the season, whether it's a player or a labelled AI ace. You're not buying a particular player, and we don't guarantee any number of views or clicks.
• A slot is held for you for 30 minutes while you pay. Payment is handled by Stripe.
• Every banner is reviewed by a person before it goes live. If we reject it, you get a full refund.
• Your banner and link must be legal and truthful, and must not contain: adult or sexual content, violence or hate, gambling, tobacco, weapons, drugs, scams, malware, political or election ads, or anything that infringes someone else's rights. We decide what's acceptable, and we may remove a live banner that breaks these rules; if we do, you won't get a refund for it.
• Once a banner is approved and live, the booking can't be cancelled or refunded, except where the law requires it or if we can't show it because of a fault on our side.
• You confirm you have the right to use everything in your banner, and you let us display, crop and resize it on Skyad, in the hangar and on the leaderboard for the season you booked.

8. Our content

Skyad, its game, planes, artwork, music, code and brand belong to Digital Native Co. or its licensors. We give you a personal, non-transferable right to play it for your own enjoyment. You may stream and share videos and screenshots of your gameplay.

9. Changes to the game

Skyad is a live game. We may change, balance, add or remove features, planes, rules and seasons, and reset the leaderboard, at any time. We may also suspend or stop the service. If we stop it for good, we'll stop charging subscriptions and refund unused booked seasons.

10. No warranty

Skyad is provided "as is" and "as available". As far as the law allows, we don't promise that it will always work, be error-free, or be available in your country. Network delay and bugs happen in online games.

11. Limit of liability

As far as the law allows, we aren't liable for indirect or consequential losses (such as lost profits or data), and our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim, or US$50 if that's more. Nothing in these terms limits rights you have under consumer law that can't be excluded.

12. Ending this agreement

You can stop playing at any time, and ask us to delete your account. We may suspend or close accounts that break these terms.

13. Law and disputes

These terms are governed by the laws of the State of Delaware and applicable US federal law, without regard to conflict-of-law rules. If you're a consumer, you also keep the protection of the mandatory laws of the country you live in. Please contact us first; most problems can be solved quickly by email.

14. Changes to these terms

If we change these terms, we'll update the date at the top. For significant changes, we'll tell signed-in players in the game before they take effect. If you keep playing after that, the new terms apply.
